Racing
Racing is a class one misdemeanor under Virginia law, that is, someone found guilty of racing can be sentenced to a year in jail and a fine of $2, 500. The person can also be sentenced to less than a year in jail, a fine only or jail and a fine.
It can be charged under section 46.2 – 865 or the reckless driving statutes. However charged, the penalty is the same, the only difference is the civil penalties. After a conviction of racing under Section 46.2 – 865, the court must suspend the defendant's driver license for six months and the car used is subject to forfeiture.
